Raja Warring Row: Election Commission objects to SC Commission’s Summoning Order; Asks to Withdraw Its Order Stating It as Interference in Election Process

In a sharp response to Punjab State SC Commission’s move summoning two key election officials amid the ongoing Tarn Taran Assembly bypoll, the Chief Electoral Officer (CEO), Punjab has written to the Commission, objecting to its order and terming it as interference in the conduct of elections.
In a letter addressed to the Chairman of the Punjab State SC Commission, the CEO Punjab referred to the Commission’s earlier communication dated November 4, 2025, in which the Returning Officer-cum-SDM Tarn Taran and District Election Officer (DEO)-cum-Deputy Commissioner Tarn Taran were summoned to Chandigarh.
Citing Article 324 of the Constitution of India, the CEO’s office reminded the Commission that the superintendence, direction, and control of all elections to Parliament and State Legislatures rests solely with the Election Commission of India (ECI).
The letter also invoked Section 13CC of the Representation of the People Act, 1950, and Section 28A of the 1951 Act, clarifying that officers on election duty are on deputation to the Election Commission and are under its “control, superintendence, and discipline.”
The CEO’s office cautioned that summoning these officers during the election period — when polling in Tarn Taran is scheduled for November 11, 2025 — could “cause interference in the conduct of election and amount to undue influence.”
The letter formally requested the SC Commission to withdraw the order summoning the officers and to avoid any actions that could disrupt the ongoing election process.
The communication comes amid heightened political tension following the controversy arose after PCC Chief Amrinder Singh Raja Warring made some "unwanted" reference about late HM Buta Singh leading to registration of FIR against Warring under SC act.
