High Court fines Haryana Staff Selection Commission ₹3 Lakh for Unfair Rejection of Woman in Constable Physical Test
Chandigarh, November 21, 2024:
The Punjab and Haryana High Court recently imposed a ₹3 lakh fine on the Haryana Staff Selection Commission (HSSC) due to the wrongful disqualification of a female candidate during the physical assessment phase for a constable role. The court determined that the Commission's decision to disqualify the applicant lacked adequate justification and did not adhere to proper procedure.
The case centered around a female applicant who was disqualified in the physical efficiency test, a key step in the hiring process for constables. Upon reviewing the case, the High Court found the rejection to be unjust, leading to the financial penalty imposed on the Commission. The judgment raised concerns about the transparency and fairness of recruitment processes, which, according to the court, had been compromised in this instance.
In addition to the fine, the court ordered the HSSC to reassess the candidate's eligibility, following appropriate guidelines for physical evaluation. This ruling serves as a caution against administrative misconduct and highlights the judiciary's role in promoting fair recruitment practices in public sector jobs.
