ECI enforces Model Code, halts fresh MP/MLA funds in by-election areas; Watch Video

New Delhi, May 25, 2025: In a move to uphold electoral integrity, the Election Commission of India (ECI) has imposed a strict ban on the release of fresh funds under the MPs’ and MLAs’ Local Area Development (LAD) Schemes in constituencies slated for upcoming bye-elections.
The directive, issued today, May 25, 2025, comes into effect immediately across five Assembly constituencies in Gujarat, Kerala, Punjab, and West Bengal, where bye-election schedules have been officially notified.

According to the ECI, the enforcement of the Model Code of Conduct (MCC) aims to ensure a level playing field for all political parties and candidates, prohibiting financial and administrative advantages during the election period.
Key Provisions of the Directive:
- Complete Ban on New Fund Releases: No fresh disbursal of MP/MLA LAD funds is allowed in any part of the election-bound districts until the conclusion of the election process.
- Constituency-Specific Restriction in Urban Areas: In cases involving state capitals or metropolitan areas, the restriction applies only to the specific constituency going to the polls.
- Freeze on New Projects: Even if work orders were previously issued, no new project may commence unless physical work has already begun on the ground.
- Ongoing Projects May Proceed: Projects already underway may continue as scheduled.
- Payments Permitted for Completed Works: Funds may be released for fully completed projects, subject to verification and satisfaction of concerned authorities.
- Execution Allowed for Pre-funded Projects with Materials Delivered: Projects where materials have already been delivered and funds allocated may proceed as planned.
The directive was formally communicated to the Cabinet Secretary, the Department of Programme Implementation, Chief Secretaries, and Chief Electoral Officers of the concerned states to ensure comprehensive compliance.
The order was signed by Ashwani Kumar Mohal, Secretary, the Election Commission of India.
