HC seeks report from Muktsar District Judge over discrepancy in ADJ order
Chandigarh, September 24: The Punjab and Haryana High Court has sought a status report from the District Judge, Sri Muktsar Sahib, regarding certain discrepancies noticed in an order passed by an Additional District Judge in an execution matter involving the Punjab State Warehousing Corporation.
The matter came before Justice Ms Lapita Banerji in a revision petition arising out of execution proceedings related to an arbitration award in favour of the Punjab State Warehousing Corporation against an industrial unit over an alleged short supply of rice against paddy entrusted to it.
During the hearing, the High Court was informed that an order dated August 19, 2026, passed by the Additional District Judge, Muktsar Sahib, referred to a stay on the proceedings by the High Court. It was subsequently pointed out that the stay concerning the award had actually been granted by a District Court judge in Chandigarh, who was hearing a challenge to the award.
Taking note of the issue, Justice directed that a status report be obtained from the District Judge, Sri Muktsar Sahib, explaining the circumstances leading to the observations recorded in the August 19 order.
The Court also noted certain differences in the recording of appearances and the status of the parties in the order and sought an explanation regarding these aspects.
The execution proceedings relate to an arbitration award, and the Additional District Judge had earlier issued warrants of attachment of property of the judgment debtors. The matter was subsequently brought before the High Court by the judgment debtors.
Senior Advocate Vijay Kumar Jindal, along with Advocates Ajay Pal Singh, Abhishek Shukla and Vijayveer, represented the petitioners. Standing Counsel Abhilaksh Gaind, assisted by Advocates Rakesh Roy and Priya Jarial, appeared for the respondents.
