SAD demands removal of Kunwar Vijay Partap from SIT
Chandigarh November 15, 2018 - The Shiromani Akali Dal today demanded the immediate removal of the IG Police (Punjab) Kunwar Vijay Pratap Singh as member of the SIT set up by the Punjab Government under the chairmanship of the ADGP Mr Prabodh Kumar .
“The utterly unwarranted, unprofessional and biased utterances of Kunwar Vijay Pratap Singh before the media have revealed a shocking degree of personal prejudice and malice in the officer, putting a serious question mark over his credibility, professional competence , impartiality and integrity. This will completely defeat the purpose of a free and fair inquiry . In the interest of the people of Punjab having faith in the fairness and credibility of the probe, it is absolutely imperative that Kunwar Vijay Pratap Singh be removed from the the SIT as member. Further, appropriate disciplinary proceedings must be initiated against the officer under the relevant provisions of law and conduct rules in the light of his utterances and actions unbecoming of the high office he occupies,” said Dr Daljeet Singh Cheema and Mr Mahesh Inder Singh Grewal, the Senior Vice Presidents of the SAD here this afternoon
Dr Cheema and Mr Grewal , who were addressing mediapersons at the party headquarters disclosed that the a communication in this regard has been sent to to the Punjab Chief Secretary.
The Akali leaders however firmly and categorically reiterated that both the former Chief Minister Sardar Parkash Singh Badal and SAD President Sardar Sukhbir Singh Badal “will fully cooperate with the SIT’s probe. We are more keen than anybody else that truth be fully brought out at th earliest. Both Sardr Badal and Sardar Sukhbir Singh have always had the highest respect for the law of the land and are fully committed to abiding by it.
They also released copies of the communication sent to the Chief Secretary in this regard. A copy of that communication has been marked to the Punjab CM Captain Amarinder Singh to seek his intervention to ensure that action be taken on the SAD demand., said Dr Cheema and Mr Grewal.
COPY OF THE COMMUNICATION SENT TO THE CM
Dear Sir,
- A Notice dated 9.11.2018 was issued by Mr. Kunwar Vijay Pratap Singh, Member SIT to Sh. Parkash Singh Ji Badal, knowing fully well that the said notice was wholly against the mandate of law in as much as section 160 Cr. P.C. requires that a male above 65 years of age could be examined as a witness at his normal place of residence and at no other.
- The notice also describes the two normal places of residence of the Former Chief Minister, one being House No. 45, Sector 2, Chandigarh, which is the place of residence of the incumbent CM, revealing absolute non application of mind by the said officer.
- Further in continuation of the notice dated 9.11.2018, an amended notice dated 12.11.2018 has been issued mentioning that the words “Circuit House Amritsar” are substituted with the words “Place of convenience”, whereas Section 160 of the Cr.P.C. clearly mandates the attendance at no other place than the place where such male person resides; further showing the indifference to law and defiance thereof and reasons totally extraneous, known only to him.
- These notices are clearly a result of some malice and bias in the mind of the officer for reasons, as would be demonstrated here in under, purely political and such indifference to law is not expected from an officer of the level of IG, who is expected to be well versed and conversant with the law.
- In addition, the reasons impelling to seek the removal of Mr. Kunwar Vijay Pratap Singh as member of the SIT, a body we hope and expect to be impartial as the Shiromani Akali Dal and its Patron S. Parkash Singh Ji Badal are always committed to co-operate and submit to the law of the land as law abiding citizens.
- It is further reiterated that there shall be complete co-operation with an impartial and fair SIT, subject to the caveat that Mr. Kunwar Vijay Pratap Singh is not associated as a member of the SIT, who publicly demonstrates his indifference to law, his malice, his biases and political affiliations as detailed below:-
- On 11.11.2018, Mr. Kunwar Vijay Pratap Singh, member of SIT, during the ongoing sensitive investigation participated and shared the stage in the company of several Congress MLAs and leaders at a function to commemorate the Birth celebrations of the Congress leader Late Sh. Khushhal Bahl. The Hindustan Times Newspaper dated 12/11/2018, Page 6 is annexed herewith as Annexure 1.
- As reported in Hindustan Times Newspaper dated 13/11/2018, Page 2 (photocopy is at Annexure 2), Mr Kunwar Vijay Pratap Singh made unprofessional, undesirable, unwarranted loose comments with derogatory undertones with malice and bias against the five time Chief Minister and the senior most elected representative of the Vidhan Sabha, which are reproduced here in below:-
“You just tell me, is the former Chief Minister not fit enough to join the probe when he is addressing political rallies across the state. Moreover, Badal Saab, who has been given a Z+ security, travels in luxury cars provided by the State and Central Government”
iii. The tone and tenor of Sh. Kunwar Vijay Pratap Singh, being a member of the SIT, in his frequent undesired interactions with the print and the electronic media especially with Mr Aseem Bassi of ABP Sanjha (https://youtu.be/Vu9T2Yenn6s) and Mr Yadwinder Singh of News 18 (http://www.facebook.com/778774518952814/posts/1181503842013211/) regarding the ongoing sensitive investigation reveal his biases and political inclinations.
- It is therefore requested as under, in the interest of fair and impartial investigation with the aim to unravel the plot that is being engineered against the SAD by its political opponents through Mr Kunwar Vijay Partap Singh:-
i. Mr Kunwar Vijay Pratap Singh should be immediately disassociated from the SIT on account of his demonstrating unprofessional conduct, disobedience of the law of the land, his malice and his political leanings.
ii. That appropriate action under the All India Services (Conduct) Rules, 1968, for violation of Rule 3(i)(1A)(II) and (IV) and Rule 5 and any other relevant rule thereof be taken against Sh. Kunwar Vijay Pratap Singh.
